The new Portuguese Nationality Law, approved by Organic Law no. 1/2026 of 18th May, entered into force on 19th May 2026.
The new legislation introduces significant changes to the criteria for acquiring Portuguese nationality, with a direct impact on foreign citizens and their families.
It should be noted that the new legal framework still requires further regulation. The Government is expected to approve the implementing regulation within 90 days, which should clarify several practical aspects regarding the application of the new rules.
The new law introduces significant changes to the requirements for obtaining Portuguese nationality. In particular, the minimum period of legal residency has been increased to 7 years for citizens of Portuguese-speaking countries and European Union citizens and to 10 years for citizens of all other countries. The legislation also establishes stricter integration requirements, including knowledge of the Portuguese language and culture, understanding of fundamental rights and duties, and evidence of an effective connection to the Portuguese community. In addition, certain specific routes to nationality acquisition, including special regimes previously available under Portuguese law, have been eliminated.
The amendments represent a significant tightening of the conditions for obtaining Portuguese nationality and require careful legal assessment on a case-by-case basis. A prompt review of eligibility is strongly recommended for all individuals considering submitting nationality applications.
