In January, several companies were surprised by an email from the National Anti-Corruption Mechanism (MENAC) asking them to register on the RGPC Platform.
Decreto Lei n.º 109-E/2021 of December 9, imposes a set of obligations on companies with 50 or more employees, namely the adoption and implementation of a regulatory compliance program that must include, at least:
- A risk prevention plan for corruption and related offenses (PPR);
- a code of conduct;
- A formation program
- A reporting channel.
It is also the responsibility of the companies to be responsible for appointing a compliance officer, whose duties will be to ensure and monitor the application of this program.
MENAC is responsible for overseeing and controlling compliance with these legal obligations. Which is why it has started notifying companies to register on the platform by February February 14, 2025.
It will be up to the companies to submit the documents relating to the implementation of the regulatory compliance program on the platform.
Failure to comply with the obligations may lead to the imposition of administrative offenses with fines ranging from €3,740.98 to €44,891.81.
