Legal Alert | Inspective Action by the Working Conditions Authority (ACT) | Gender Pay Gap

Under Article 5 of Law no. 60/2018, of August 21, and taking as its motto the maxim “for equal work, equal pay”, in the first days of 2025 the ACT began an inspection campaign aimed at monitoring wage inequalities between men and women.

Based on the 2023 statistical information published by the Ministry of Labor and Employment, and the wage discrepancies identified, ACT is notifying several companies to submit, within 120 working days, a Plan for Evaluating Gender Pay Gaps.

This plan, to be implemented over 12 months, must be based on a salary evaluation of the various functions, applying objective criteria, common to both men and women, excluding any possibility of discrimination.

Employers who fail to submit an action plan within 120 working days may incur in administrative liability.

Therefore, it’s recommended a detailed analysis of the guidelines made available by ACT regarding the Evaluation Plan, and that “specific, measurable and achievable” measures be adopted to reduce the pay gap between men and women.
