{"id":46110,"date":"2026-05-28T16:01:54","date_gmt":"2026-05-28T16:01:54","guid":{"rendered":"https:\/\/crs-advogados.com\/legal-alert-ing-package-decree-law-no-97-2026-of-20-may-tax-incentives-and-new-affordable-rental-regime\/"},"modified":"2026-05-28T16:27:44","modified_gmt":"2026-05-28T16:27:44","slug":"legal-alert-ing-package-decree-law-no-97-2026-of-20-may-tax-incentives-and-new-affordable-rental-regime","status":"publish","type":"post","link":"https:\/\/crs-advogados.com\/en\/legal-alert-ing-package-decree-law-no-97-2026-of-20-may-tax-incentives-and-new-affordable-rental-regime\/","title":{"rendered":"Legal Alert | Housing Package \u2013 Decree-Law No. 97\/2026 of 20 May \u2013 Tax incentives and new affordable rental regime"},"content":{"rendered":"\t\t<div data-elementor-type=\"wp-post\" data-elementor-id=\"46110\" class=\"elementor elementor-46110\" data-elementor-post-type=\"post\">\n\t\t\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-4eea709c elementor-section-boxed elementor-section-height-default elementor-section-height-default sc_fly_static\" data-id=\"4eea709c\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-extended\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-61c36c6 sc_inner_width_none sc_content_align_inherit sc_layouts_column_icons_position_left sc_fly_static\" data-id=\"61c36c6\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-4412ebb sc_fly_static elementor-widget elementor-widget-text-editor\" data-id=\"4412ebb\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>On 20 May 2026, the Council of Ministers approved a new, expanded package of measures to encourage home ownership and residential rental\/subletting, focusing on tax benefits and new investment regimes.<\/p><p>We highlight the following changes:<\/p><ol><li><strong>Tax incentives for housing and rental<\/strong><\/li><\/ol><p><strong>6% VAT on construction\/renovation<\/strong><\/p><p>Amendment to the VAT Code, allowing the reduced rate of 6% to be applied to construction or renovation works on properties that:<\/p><ol><li>a) are intended for the purchaser\u2019s own permanent residence; or<\/li><li>b) are intended exclusively for residential rental,<\/li><\/ol><p>Provided that the sale price or rent falls within the \u2018moderate value\u2019 limits (rent up to 2.5 times the minimum wage for 2026; sale price within the limits of the 2nd bracket of the Property Transfer Tax (IMT)).<\/p><p><strong>Income Tax \u2013 capital gains and rent deductions<\/strong><\/p><p>Two key changes have been made to Income Tax:<\/p><ol><li>a) Capital gains on the sale of property may be exempted if the proceeds are reinvested in properties intended for low-rent housing, provided that deadlines and other conditions are met.<\/li><li>b) The annual deduction for rent paid by tenants rises to \u20ac900 in 2026 and \u20ac1,000 from 2027 onwards.<\/li><\/ol><p><strong>Property Transfer Tax (IMT) and affordable housing<\/strong><\/p><p>With regard to Property Transfer Tax (IMT), the legislation provides, in particular, for:<\/p><ol start=\"7\"><li>a) A flat rate of 7.5% for non-residents purchasing a property in Portugal, unless the buyer becomes a tax resident in Portugal within two years or uses the property for low-rent residential rental for at least 36 months during the first five years.<\/li><li>b) A regime of controlled-cost housing, with exemption from IMT up to a certain value and a reduction in stamp duty on the first purchase of social housing, provided the legal requirements are met.<\/li><\/ol><p><strong>Property income \u2013 10% tax rate and reduction in the tax base<\/strong><\/p><p>A special regime for property income is also introduced:<\/p><ol><li>a) A 10% flat-rate tax under the personal income tax (IRS) regime on rental income from residential property, where the rent falls within the moderate limits (up to \u20ac2,300), until 31 December 2029, unless a more favorable regime applies.<\/li><li>b) Only 50% of this income is included in the tax base for corporation tax or personal income tax where organized accounting is used.<\/li><li><strong>Rental Investment Contracts (CIA)<\/strong><\/li><\/ol><p>The Decree-Law establishes Rental Investment Contracts (CIA), aimed at large-scale residential rental projects.<\/p><ol><li>a) The CIA is entered into between the investor and IHRU, I. P., with a term of up to 25 years.<\/li><li>b) At least 70% of the area must be allocated to residential rental, with rents within the moderate limits defined in the legislation.<\/li><\/ol><p>In return, the investor may benefit from exemptions or reductions in IMT, IMI, AIMI, stamp duty and a reduced VAT rate on construction works, as well as a partial VAT refund on technical services.<\/p><p>Failure to comply with the conditions of the CIA may result in the loss of some or all the tax benefits, with repayment and interest.<\/p><ol start=\"3\"><li><strong> Simplified Affordable Rental Scheme (RSAA)<\/strong><\/li><\/ol><p>The RSAA replaces the former Affordable Rental Program and becomes the standard framework for contracts classified as \u201caffordable rentals\u201d.<\/p><ol><li>a) It covers residential tenancy and subletting agreements, including municipal programs.<\/li><li>b) Rents must be below a ceiling per property type, based on 80% of the median rent per square meter in the municipality, to be set by ministerial order.<\/li><li>c) Minimum term: 3 years for permanent residence and 3 months for temporary residence.<\/li><li>d) Property income from contracts complying with the RSAA is exempt from personal income tax (IRS) and corporate income tax (IRC), provided the contract is registered on the IHRU platform and reported to the Tax Authority (AT) via that channel.<\/li><li><strong> Timetable \u2013 Effective dates<\/strong><\/li><\/ol><p>The legislation will be implemented in phases:<\/p><ol><li>a) 1 January 2026 \u2013 the main amendments to the CIRS (personal income tax code) and the EBF (tax benefits code) (including the 10% rate and the reduction in the tax base for rental income) and the first VAT measures.<\/li><li>b) 1 September 2026 \u2013 Entry into force of the new CIA and RSAA regimes;<\/li><\/ol><p>In light of these changes, it is important to analyze the potential tax implications arising from them.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section
