{"id":45923,"date":"2026-03-02T17:05:06","date_gmt":"2026-03-02T17:05:06","guid":{"rendered":"https:\/\/crs-advogados.com\/legal-alert-act-inspections-in-2026-how-to-prepare-your-company\/"},"modified":"2026-03-11T10:46:22","modified_gmt":"2026-03-11T10:46:22","slug":"legal-alert-act-inspections-in-2026-how-to-prepare-your-company","status":"publish","type":"post","link":"https:\/\/crs-advogados.com\/en\/legal-alert-act-inspections-in-2026-how-to-prepare-your-company\/","title":{"rendered":"Legal Alert | ACT inspections in 2026: how to prepare your company"},"content":{"rendered":"\t\t<div data-elementor-type=\"wp-post\" data-elementor-id=\"45923\" class=\"elementor elementor-45923 elementor-45872\" data-elementor-post-type=\"post\">\n\t\t\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-4eea709c elementor-section-boxed elementor-section-height-default elementor-section-height-default sc_fly_static\" data-id=\"4eea709c\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-extended\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-61c36c6 sc_inner_width_none sc_content_align_inherit sc_layouts_column_icons_position_left sc_fly_static\" data-id=\"61c36c6\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-4412ebb sc_fly_static elementor-widget elementor-widget-text-editor\" data-id=\"4412ebb\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>At the beginning of February, the Authority for Working Conditions (ACT) announced that it would be carrying out nationwide inspections throughout 2026, with a particular focus on areas considered to be priorities in the Portuguese labor market.<\/p>\n<p>These inspections will be mainly focused on:<\/p>\n<ol>\n<li>Inadequate contractual relationships;<\/li>\n<li>The private security sector;<\/li>\n<li>Promoting equal pay for women and men.<\/li>\n<\/ol>\n<p>Failure by companies to comply with the legal obligations may result in administrative offenses punishable by fines, as well as the imposition of corrective measures by ACT.<\/p>\n<p><strong>Inadequate contractual relationships<\/strong><\/p>\n<p>During the first half of 2026, ACT will pay particular attention to verifying the regularity of contractual relationships, particularly in the following cases: false provision of green receipts, undeclared work, misuse of fixed-term contracts, and temporary work.<\/p>\n<p><strong>Private security sector<\/strong><\/p>\n<p>Also in the first quarter of 2026, ACT intends to inspect employers operating in the private security sector.<\/p>\n<p>In this context, ACT will focus its attention on the organization of working hours, payment of salaries, and other benefits, always bearing in mind the Collective Labor Regulation Instruments applied to the respective sector.<\/p>\n<p><strong>Equal pay for women and men<\/strong><\/p>\n<p>Inspections in the area of equal pay for women and men began in 2025 and will continue throughout 2026. The \u201cPay Transparency\u201d Directive (Directive 2023\/970, EU), which must be transposed by June 7, 2026, reinforces companies&#8217; obligations in this area. In this context, ACT&#8217;s inspection activity already anticipates verification of compliance with the requirements arising from this new European framework.<\/p>\n<p>In view of the increased inspections in these areas, there are some practical recommendations for companies, namely:<\/p>\n<ol>\n<li>Review the legal classification of existing contractual relationships;<\/li>\n<li>Verify the regularity of the social security contribution framework for employees;<\/li>\n<li>Ensure the timely payment of wages and allowances;<\/li>\n<li>Evaluating remuneration policies in light of the principle of equal pay;<\/li>\n<li>Complying with rules on working time;<\/li>\n<li>Ensuring that employment documentation is up to date and accessible in the event of an inspection.<\/li>\n<\/ol>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section
